RULES OF BUSINESS
In exercise of the powers conferred by Articles 90 and 99 of the Constitution of the Islamic Republic of Pakistan, the Federal Government is pleased to make the following rules:-
PART A.—GENERAL
-
Title, commencement and application.—
(1) These rules may be called the “Rules of Business, 1973.”
(2) They shall come into force on the fourteenth day of August 1973.
(3) They shall also apply, mutatis mutandis, when the business of the Government is conducted through automated or digitalized applications, platforms or systems.
(3) یہ قواعد بھی اسی طرح (معمولی تبدیلی کے ساتھ) اس وقت لاگو ہوں گے جب حکومت کا کام کاج خودکار یا ڈیجیٹل ایپلی کیشنز، پلیٹ فارمز یا سسٹمز کے ذریعے چلایا جائے گا۔

Allocation of Business
(1) تمام وزارتوں اور ڈویژنز کی باقاعدہ فہرست Schedule I کے تحت مرتب کی جاتی ہے۔
(2) ضرورت پڑنے پر وزیراعظم کوئی نئی وزارت یا محکمہ تشکیل دے سکتے ہیں۔
(3) یہ طے کرنا کہ کس محکمہ نے کیا کام کرنا ہے، اور وزیراعظم جب چاہیں اس میں ردوبدل کر سکتے ہیں، کام کی تقسیم کے تحت آتا ہے۔
(4) وزیراعظم محکمے وزراء کو بانٹتے ہیں۔ جو محکمہ کسی وزیر کو نہ ملے وہ وزیراعظم کے پاس رہتا ہے۔ وزیراعظم کسی وزیرِ مملکت یا مشیر کو بھی کوئی محکمہ سونپ سکتے ہیں۔ ایک وزیر کے پاس ایک سے زیادہ محکمے بھی ہو سکتے ہیں۔

Organization of Divisions
(1) ہر ڈویژن کا ایک انتظامی سربراہ (Secretary) اور دیگر ماتحت عملہ ہوتا ہے، اور ایک ہی شخص ایک سے زیادہ ڈویژنز کا Secretary بھی بن سکتا ہے۔
(2) Secretary ڈویژن کا سرکاری سربراہ ہوتا ہے جو بہتر انتظامیہ، نظم و ضبط، قواعد کے مطابق کام چلانے اور منظور شدہ پالیسی پر عمل درآمد کا ذمہ دار ہوتا ہے۔
(3) Secretary ڈویژن کے کام کو چھوٹے کام کرنے والے حصوں یعنی “Sections” میں تقسیم کرتا ہے، یا Establishment Division کی مشاورت سے دوسری مستقل ذیلی تقسیمات قائم کرتا ہے۔
(4) مختلف ڈویژنز کے ساتھ منسلک محکمے (Attached Departments) Schedule III میں درج ہوتے ہیں۔
(5) Secretariat یا Attached Departments کے علاوہ سرکاری کام وزیراعظم کے بتائے ہوئے دیگر اداروں اور دفاتر کے ذریعے چلایا جاتا ہے۔
(6) وزیراعظم اپنے اختیارات اور کام میں مدد کے لیے مخصوص درجے اور فرائض کے ساتھ خصوصی معاونین (Special Assistants) مقرر کر سکتے ہیں۔

Transaction of Business
(1) وزیراعظم اپنے وزراء سے اس میں مدد لیتے ہیں۔
(2) وزراء وزیراعظم کی منظوری سے اہم پالیسی فیصلے کرتے ہیں۔
(3) تمام اہم پالیسی فیصلے وزیراعظم کی منظوری سے ہوتے ہیں۔ وزیراعظم اپنے اختیارات اور فرائض کسی وزیر کو تفویض یا کسی کو اپنا نائب نامزد کر سکتے ہیں۔
(4) وزراء وزیراعظم کو اہم فیصلوں سے باخبر رکھنے کے ذمہ دار ہیں۔
(5) وزیراعظم کی منظور کردہ پالیسی کو تبدیل یا رد نہیں کیا جا سکتا۔ وزیر اور اپنے ڈویژن کی پالیسی کے خود ذمہ دار ہوتے ہیں۔
(6) اور (7) عام طور پر Secretary، Additional Secretary، Joint Secretary یا Secretary ہی متعلقہ وزیر سے سرکاری کام کے سلسلے میں رابطہ کر سکتے ہیں، اور Attached Departments کے سربراہان کو بھی وزراء تک رسائی حاصل ہوتی ہے۔
(8) وزیر کی اجازت سے ڈویژن کا کام چلتا ہے۔
(9) Secretary وزیر کے معاون، Principal Accounting Officer، افسر اور قوانین پر عمل درآمد کرانے کے ذمہ دار ہوتے ہیں۔
(10) اگر Secretary کو وزیر کا کوئی فیصلہ شدید غلط یا نقصان دہ محسوس ہو تو وہ نظرِ ثانی کی درخواست کر سکتے ہیں، اور معاملہ وزیراعظم تک پہنچایا جا سکتا ہے۔
(11) وزیر اور Secretary کے درمیان اختلافِ رائے کی صورت میں معاملہ وزیراعظم کے سامنے پیش کیا جاتا ہے۔
(12) قوانین یا اختیارات کے دائرۂ کار پر تنازع کی صورت میں Cabinet Division فیصلہ کرے گی۔
(13) زبانی احکامات کی صورت میں ان کی تحریری تصدیق ضروری ہوگی۔
(14) زبانی احکامات کے بعد متعلقہ احکامات کو تحریری شکل دینا ضروری ہے۔
(15) ماتحت افسر کی ذمہ داری ہے کہ وہ اس بات کی نشاندہی کرے کہ اسے ایسا حکم ملا ہے جو قوانین کے خلاف ہے۔

• Collective Responsibility: کابینہ اجتماعی طور پر ان احکامات یا دی جانے والی مشاورت کی ذمہ دار ہوتی ہے، خواہ وہ فیصلہ کسی ایک وزیر نے کیا ہو یا پوری کابینہ نے۔
• Individual Responsibility: اس کے باوجود، ہر وزیر اپنے محکمہ (Portfolio) کے روزمرہ کے کاموں کو نمٹانے کی بنیادی ذمہ داری خود اٹھاتا ہے۔

(6) دستخط اور توثیق: صدر کے نام پر بننے والے احکامات اور دستاویزات پر دستخط کرکے ان کی توثیق کرنے کے لیے کسی افسر کو مجاز کیا جا سکتا ہے، یا وزیراعظم کسی خاص موقع کے لیے Schedule IV میں درج افسران کو یہ اختیار دے سکتے ہیں۔
(7) بین الاقوامی اور خارجہ امور: بیرونِ ملک پاکستان کی نمائندگی، بین الاقوامی کانفرنسوں، معاہدوں اور دیگر خارجہ امور میں احکامات و توثیق کا طریقۂ کار Ministry of Foreign Affairs Division کے ذریعے جاری کیا جائے گا۔

PART B.-CONSULTATION AMONG DIVISIONS

Inter-Division Procedure
(1) مشاورت کے درمیان ڈویژنز: جب کوئی معاملہ ایک سے زیادہ ڈویژنز سے متعلق ہو، تو اصل ڈویژن کی ذمہ داری ہے کہ وہ دوسرے متعلقہ ڈویژنز سے مشورہ کرے، اور تمام متعلقہ ڈویژنز کی رائے لینے سے پہلے کوئی حکم جاری نہیں کیا جائے گا اور نہ ہی معاملہ کابینہ یا وزیراعظم کو بھیجا جائے گا۔ (ہنگامی صورتِ حال میں وزیراعظم کی منظوری سے اس شرط کو عارضی طور پر چھوڑا جا سکتا ہے۔)
(2) جواب دینے کا وقت: جس ڈویژن سے رائے مانگی گئی ہو، اسے عام طور پر تین کام کے دنوں کے اندر اپنی رائے دینی ہوتی ہے، اور پیچیدہ معاملے پر تاخیر ہونے کی صورت میں اتنے ہی دنوں میں جواب دینے کا متوقع وقت بتانا لازمی ہے۔
اختلافِ رائے کا حل: اگر ڈویژنز کے درمیان اختلافِ رائے ہو تو متعلقہ وزراء باہمی مشاورت سے اسے حل کرنے کی کوشش کرتے ہیں؛ اتفاق نہ ہونے پر معاملہ وزیراعظم یا کابینہ کے سامنے پیش کیا جاتا ہے۔
(3) مراسلت کا مکمل طریقہ: جب ایک ڈویژن دوسرے ڈویژن کو مشورے کے لیے فائل بھیجے تو تمام حقائق واضح لکھے جانے چاہئیں تاکہ بار بار خط و کتابت کی ضرورت نہ پڑے، اور جواب بھی تمام نکات کا احاطہ کرنے والا مکمل ہونا چاہیے۔
(4) معلومات اور خفیہ دستاویزات کا تبادلہ: ایک ڈویژن دوسرے دلچسپی رکھنے والے ڈویژن کو معلومات کے لیے کاپی بھیج سکتا ہے، بشرطیکہ خفیہ دستاویزات کی تقسیم جہاں مشاورت لازمی نہ بھی ہو، Cabinet Division کے اصولوں کے مطابق ہو اور سائفر و ٹیلی گرام کے قوانین Ministry of Foreign Affairs، Defence اور Cabinet Division طے کریں۔
(5) دوسری ڈویژن کی فائل طلب کرنا: کوئی بھی وزیر اپنے ڈویژن کے کام کے سلسلے میں کسی دوسرے ڈویژن کی فائل منگوا سکتا ہے۔
(6) وزیرِ خزانہ مالیاتی معاملے پر کسی بھی ڈویژن کی فائل دیکھ سکتے ہیں، جبکہ وزیراعظم کسی بھی ڈویژن سے کوئی بھی کیس طلب کر سکتے ہیں۔
(7) مزید کارروائی کا طریقہ: اگر کوئی وزیر کسی دوسرے ڈویژن کے کیس پر مزید کارروائی چاہتا ہے، تو اسے متعلقہ ڈویژن کے وزیر سے ہی یہ معاملہ اٹھانا ہوگا۔

Secretaries’ Committee
(1) مقصد اور قیام: یہ Committee سینئر افسران کے اجتماعی تجربے اور دانش سے فائدہ اٹھانے کے لیے بنائی گئی ہے تاکہ کسی بھی وزیرِ ڈویژن، انچارج، وزیراعظم یا کابینہ کی طرف سے بھیجے گئے معاملات پر بحث کی جا سکے۔
(2) اختلافِ رائے کا حل: جب دو یا دو سے زیادہ ڈویژنز کے درمیان کسی معاملے پر اختلاف ہو تو اسے کابینہ یا وزیراعظم کو بھیجنے سے پہلے Committee میں اس پر غور کیا جاتا ہے تاکہ حل نکالا جا سکے یا واضح سفارشات تیار کی جا سکیں۔
(3) سرکاری ملازمین کے امور: Civil Servants کی career progression اور service structure اور شرائط و ضوابط سے متعلق تمام پالیسی امور جو وزیراعظم یا کابینہ کے سامنے پیش کیے جانے ہوں، ان پر Committee میں پہلے ان کی رائے اور سفارشات کے لیے غور کیا جاتا ہے۔
(4) کابینہ میں رپورٹ: Cabinet Secretary کم از کم ہر سہ ماہی میں ایک بار Committee کے فیصلوں اور سفارشات کا خلاصہ کابینہ کے سامنے رپورٹ کی صورت میں پیش کرتے ہیں۔
(5) دوبارہ مشاورت کی ضرورت: اگر Committee میں کسی Division کے Secretary نے کسی تجویز پر اتفاق کر لیا ہو تو اس Division سے دوبارہ مشورہ کرنا ضروری نہیں رہتا۔
(6) دوبارہ جانچ کی ضرورت: اگر Committee میں کوئی متفقہ فیصلہ ہو جائے اور وہ کسی Secretary یا Joint Secretary کی نمائندگی میں Division کی طرف سے کیا گیا ہو تو اس Division میں دوبارہ اس کی جانچ نہیں کی جاتی۔
(7) Committee کا اجلاس: Secretaries’ Committee کا اجلاس کم از کم ایک بار ماہانہ ہونا ضروری ہے، جب تک کہ بحث کے لیے کوئی Item موجود نہ ہو، اور اس کام کے حوالے سے مزید ہدایات Cabinet Division جاری کرتی ہے۔

Consultation with the Cabinet Division
(1) پیشگی مشاورت: کوئی بھی Division، Cabinet Division سے پہلے مشورہ کیے بغیر ایسے احکامات جاری نہیں کر سکتا جو کسی وزارت کے اندر Division کے کام کی تقسیم، قوانین کی تشریح، یا دیگر متعلقہ امور سے متعلق ہوں۔
(2) وزراء اور خصوصی معاونین: وزراء، وزراءِ مملکت اور خصوصی معاونین کے ذاتی عملے کی تعداد اور سروس کی شرائط و ضوابط سے متعلق تبدیلی یا تقسیم کے لیے متعلقہ Division کی تجاویز Cabinet Division سے پیشگی مشاورت کے بعد کی جائیں گی۔
(3) صوبائی گورنر کو ہدایات: Article 145 کے تحت صدر کی طرف سے صوبے کے گورنر کو دی جانے والی ہدایات سے متعلق تجاویز متعلقہ Division کی طرف سے Cabinet Division کو بھیجی جائیں گی۔
(4) بین الاقوامی کانفرنسوں کے لیے وفد بھیجنا: اگر کسی بین الاقوامی کانفرنس کے لیے کوئی وفد بھیجنا ہو تو اس کی تجویز Cabinet Division کو بھی دی جائے گی اور صدارتی حکم نامے کی ایک کاپی بھی Cabinet Division کو بھیجی جائے گی۔
(5) درجہ بندی اور رازداری: اگر وفد بھیجنے یا بین الاقوامی کانفرنس سے متعلق معاملہ Cabinet Division کے مقرر کردہ طریقۂ کار کے مطابق نہ ہو تو متعلقہ Division کو اس سلسلے میں Cabinet Division سے کلیئرنس لینا ہوگی۔

Consultation with the Establishment Division
(a) پیشگی مشاورت: کوئی بھی Division، Establishment Division سے پہلے مشورہ کیے بغیر ایسے احکامات جاری نہیں کر سکتا جو درج ذیل امور سے متعلق ہوں:

Consultation with the Finance Division
(1) پیشگی مشاورت: کوئی بھی Division، Finance Division سے پہلے مشورہ کیے بغیر ایسے احکامات جاری نہیں کر سکتا جو وفاقی مالیات کو براہِ راست یا بالواسطہ طور پر متاثر کریں، خصوصاً درج ذیل امور:
(a) Revenue میں چھوٹ دینا، Revenue کو معاف کرنا، اس کی منتقلی کرنا، یا اس کے خلاف کوئی ضمانت دینا۔
(b) Budget سے باہر ایسا خرچ کرنا جو وفاقی مالیات کو متاثر کرے۔
(d) قرض کا حصول یا قرض (Loan) جاری کرنا۔
(e) Budget Grant میں ردوبدل۔
(f) Accounts یا Budget کی ترتیب میں تبدیلی، یا Budget Estimates کے طریقۂ کار میں تبدیلی۔
(g) Foreign Currency میں تبدیلی، جب Budget میں اس کا کوئی انتظام نہ ہو یا اس کی کوئی منظوری نہ دی گئی ہو۔
(h) سرکاری ملازمین کی سروس کی شرائط و ضوابط یا قانونی حقوق اور مراعات میں ایسی تبدیلی جس کے مالی اثرات ہوں۔
(i) Finance Division کی جانب سے بنائے گئے قوانین کی تشریح۔
(2) اختلافِ رائے اور منظوری کا طریقہ: جس تجویز پر Finance Division کی منظوری (Concurrence) درکار ہو، اس پر مزید کام اس وقت تک نہیں کیا جا سکتا جب تک Finance Division اپنی منظوری نہ دے۔ اگر متعلقہ وزیر اور وزیرِ خزانہ کے درمیان کسی تجویز پر اتفاق نہ ہو تو وزیر اپنی تجویز پر اصرار کر سکتا ہے اور معاملہ وزیراعظم یا کابینہ کو بھیجا جا سکتا ہے۔ Finance Division کی تفصیلی جانچ پڑتال کے بغیر کوئی باقاعدہ حکم جاری نہیں کیا جائے گا۔
(3) Audit Authorities کو احکامات: Finance Division کے بنائے ہوئے قواعد کے تحت اختیارات کی تفویض کے علاوہ، ہر وہ حکم جس پر Audit میں عمل درآمد ہونا ہو، Finance Division کے ذریعے Audit Authorities کو بھیجا جائے گا۔

Consultation with the Foreign Affairs Division
پیشگی مشاورت: تمام ایسے معاملات جو پاکستان کی خارجہ پالیسی یا اس کے غیر ملکی تعلقات کے حوالے سے متاثر ہونے والے ہوں، ان پر Ministry of Foreign Affairs سے مشورہ کیا جائے گا، بشرطیکہ متعلقہ Division کی طرف سے کسی عام یا خاص اختیارات کی تفویض کے احکامات موجود نہ ہوں۔

Consultation with the Law and Justice Division
(1) پیشگی مشاورت: کسی بھی معاملے میں جب کسی قانون، قانونی سوال، قانون کی تشریح، قانونی اختیار کے تحت کوئی Rule، Order، Notification یا Legislative Instrument جاری کرنے کا معاملہ ہو تو Ministry of Law and Justice سے مشاورت کی جائے گی۔
اسی طرح، حکومت کی طرف سے کسی عدالت میں کوئی سول یا فوجداری مقدمہ دائر کرنے سے پہلے، یا حکومت کے خلاف عدالت میں مقدمہ دائر ہونے کی صورت میں، اس Division سے مشاورت کی جائے گی۔
کسی بھی Division، Office یا Corporation میں Legal Adviser کی تقرری سے پہلے بھی Ministry of Law and Justice سے مشاورت کی جائے گی۔
فوری نوعیت کے معاملے میں Attorney-General سے مشاورت کے بعد سفارشات دی جائیں گی، جو بعد ازاں Ministry of Law and Justice کو بھیجی جائیں گی۔
کسی خاص معاملے کی مجبوری کی وجہ سے کوئی Division Private Counsel کو مقرر کر سکتا ہے، جس کے لیے Ministry of Law and Justice کو کیس بھیجا جائے گا۔
Attorney-General سے مشاورت کے بعد متعلقہ Division، Ministry of Law and Justice سے مشاورت کرکے ایسے وکیل کی تقرری کی اجازت دے سکتا ہے، بشرطیکہ مقررہ طریقۂ کار کے مطابق ہو۔
(2) Attorney-General سے رابطہ: کوئی بھی Division براہِ راست Attorney-General سے رابطہ نہیں کرے گا بلکہ Ministry of Law and Justice کے ذریعے اور مقررہ طریقۂ کار کے مطابق رابطہ کیا جائے گا۔
البتہ قومی اور بین الاقوامی سطح پر تنازعات کے حل کے لیے Arbitration کے ذریعے متعلقہ Division، Attorney-General سے براہِ راست مشورہ کر سکتا ہے۔
(3) اختلافِ رائے کا حل: اگر Attorney-General اور Minister for Law and Justice کے خیالات میں اختلاف ہو تو معاملہ وزیراعظم کو رائے کے لیے بھیجا جائے گا۔ اگر وزیراعظم کے احکامات پر بھی اختلاف ہو تو معاملہ کابینہ کو منتقل کیا جا سکتا ہے۔

Cases to be brought before the Cabinet
Rule 16(1) — Cabinet کے سامنے پیش کیے جانے والے معاملات:
(1) قانون سازی کے تمام معاملات، چاہے وہ Official Bill ہوں یا Non-Official Bill، Cabinet کے سامنے پیش کیے جاتے ہیں۔ اسی طرح Ordinance جاری کرنے یا ختم کرنے کے معاملات بھی Cabinet کے سامنے پیش کیے جاتے ہیں۔
(2) Money Bills، Budget اور Excess Budget سے متعلق اہم تجاویز Cabinet میں پیش کی جاتی ہیں۔ Supplementary Budget اور Annual Budget کے معاملات بھی Cabinet کے سامنے آتے ہیں۔
(3) Article 186(1) کے تحت قانون کے کسی سوال پر Supreme Court سے رائے لینے کا معاملہ بھی Cabinet میں پیش کیا جاتا ہے۔
(4) کسی نئے Tax کے نفاذ، Tax ختم کرنے، معاف کرنے یا اس میں تبدیلی، اور قرضہ لینے یا جاری کرنے کی تجاویز بھی Cabinet کے سامنے لائی جاتی ہیں۔
(5) بجلی پیدا کرنے اور ایک صوبے سے دوسرے صوبے تک بجلی کی Transmission Lines بچھانے کے معاملات بھی Cabinet کے سامنے آتے ہیں۔
(6) کسی غیر ملکی حکومت کے ساتھ مذاکرات شروع کرنے، معاہدے کرنے، ان پر دستخط کرنے اور ان کی Ratification (تصدیق) کے معاملات Cabinet کے سامنے پیش کیے جاتے ہیں۔
(7) بین الاقوامی اداروں کے اجلاسوں میں جانے والے وفود کی تشکیل بعض حالات میں Foreign Affairs Division اور Commerce Division کی باہمی مشاورت سے کی جا سکتی ہے، تاہم اس کے لیے پہلے متعلقہ وزیر سے اصولی منظوری لینا ضروری ہے۔
(8) مخصوص صورتوں میں بیرونِ ملک Honorary Consulate کھولنے کا فیصلہ وزیراعظم کی منظوری سے کیا جا سکتا ہے۔
(9) سیاسی، معاشی یا انتظامی پالیسیوں پر نمایاں اثر ڈالنے والے معاملات، جو National Assembly یا Senate میں پیش کیے جانے ہوں، Cabinet کے سامنے لائے جاتے ہیں۔
(10) اہم Reports اور Documents سے متعلق ایسے معاملات جنہیں Minister-in-Charge بہت اہم سمجھیں، Cabinet میں بحث کے لیے پیش کیے جا سکتے ہیں۔ اگر وزیراعظم فیصلہ کریں کہ انہیں Cabinet میں پیش کرنا ہے تو انہیں Cabinet کے سامنے پیش کیا جائے گا۔
(11) قانون کے تحت حکومت کی طرف سے کی جانے والی مخصوص Appointments بھی Cabinet کے سامنے پیش کی جاتی ہیں۔
(12) اس کے علاوہ وزیراعظم جس معاملے کو چاہیں، اسے Cabinet کے سامنے پیش کرنے کا حکم دے سکتے ہیں۔

Method of disposal of Cabinet cases
(1) Cabinet کے سامنے پیش کیے گئے معاملات کو تین طریقوں سے نمٹایا جا سکتا ہے:
(a) Cabinet کے اجلاس میں بحث کرکے؛
(b) وزراء کے درمیان معاملہ گردش (circulation) کے ذریعے؛ یا
(c) Cabinet کی کسی Committee کے ذریعے۔
(2) Cabinet کے سامنے پیش کیے گئے معاملات کی Cabinet سے توثیق (ratification) ضروری ہوتی ہے، تاہم اگر Cabinet نے پہلے سے اجازت دی ہو تو توثیق ضروری نہیں ہوگی۔
(3) اگر کسی Committee نے کسی معاملے پر فیصلہ کیا ہو تو عام طور پر اس فیصلے کی Cabinet سے توثیق (ratification) ضروری ہوتی ہے۔
(4) Cabinet Secretariat، وزیراعظم کی عام یا خاص ہدایات کے تحت فیصلہ کرتا ہے کہ کسی معاملے کو کس طریقے سے نمٹایا جائے۔
(5) Cabinet یا وزیراعظم کسی مخصوص قسم کے معاملات کے لیے Standing Committees قائم کر سکتے ہیں اور ان کے اراکین اور کام کا دائرہ مقرر کر سکتے ہیں۔
(6) Cabinet Committees دو قسم کی ہو سکتی ہیں:
(a) Standing Committee — جو مخصوص قسم کے معاملات کے لیے قائم کی جائے۔
(b) Special Committee — جو کسی مخصوص معاملے کے لیے قائم کی جائے۔ اس میں Cabinet کے اراکین کے علاوہ دوسرے مناسب افراد بھی شامل کیے جا سکتے ہیں۔
(7) اگر Cabinet کسی معاملے پر غور کرنے کے بعد مزید تفصیلی غور یا آئندہ کارروائی کے لیے کوئی Committee بنائے تو یہ Committee اپنی رپورٹ یا سفارشات دوبارہ Cabinet کے سامنے پیش کرے گی، تاکہ Cabinet ضرورت کے مطابق حتمی فیصلہ کر سکے۔

Manner of submission of Cabinet cases
(1) Cabinet Secretariat کو بھیجے جانے والے Summary میں معاملے کا پس منظر، اہم حقائق، فیصلہ کرنے والے نکات اور متعلقہ وزیر کی سفارشات شامل ہوں گی۔ Summary مختصر، واضح اور پرنٹ شدہ ہونی چاہیے۔
(2) اگر Secretary of the Division اور Minister-in-Charge کی رائے مختلف ہو تو دونوں آراء Summary میں واضح طور پر درج کی جائیں گی اور اختلاف کے نکات بھی واضح کیے جائیں گے۔
(3) اگر معاملہ نئی قانون سازی سے متعلق ہو اور اصولی منظوری (self-contained) مطلوب ہو تو Summary میں واضح طور پر بتایا جائے گا کہ قانون میں کن اہم معاملات کو شامل کیا جانا ہے۔ Summary حتیٰ الامکان مکمل اور جامع ہونی چاہیے۔
(4) اگر کسی موجودہ قانون یا Rule میں ترمیم کی تجویز ہو تو موجودہ اور مجوزہ دفعات کا تقابلی بیان (comparative statement) بھی ساتھ لگایا جائے گا۔
(5) Summary دو پرنٹ شدہ صفحات سے زیادہ نہیں ہونی چاہیے۔
(6) اگر کوئی معاملہ ایک سے زیادہ Divisions سے متعلق ہو تو اسے Cabinet میں بھیجنے سے پہلے تمام متعلقہ Divisions سے اس پر غور اور رائے لینا ضروری ہے۔ اگر ان Divisions کی آراء مختلف ہوں تو اختلاف کے نکات Summary میں واضح طور پر درج کیے جائیں گے۔
(7) Bills، Ordinances اور Orders کے مسودے Cabinet کو بھیجنے سے پہلے Law and Justice Division سے قانونی جانچ (legal vetting) کروانا ضروری ہے۔ اس کے بعد Law and Justice Division سے مشاورت کے بغیر ان میں تبدیلی نہیں کی جا سکتی۔
(8) Cabinet کے اجلاس کے Agenda میں کسی معاملے کو شامل کرنے کے لیے وہ معاملہ عام طور پر اجلاس سے کم از کم دو واضح دن پہلے Cabinet Secretariat تک پہنچ جانا چاہیے۔ اگر معاملہ انتہائی ضروری ہو اور مختصر وقت میں Cabinet کے سامنے پیش کرنا ہو تو وزیراعظم کی منظوری حاصل کرنا ہوگی۔
(9) متعلقہ Secretary کو یہ دیکھنا ہوگا کہ پیش کیے گئے کاغذات مکمل ہیں اور مقررہ طریقے کے مطابق ہیں یا نہیں۔ اگر کاغذات نامکمل ہوں تو Cabinet Secretariat معاملہ واپس کر سکتا ہے۔
(10) اگر Cabinet Secretariat کو لگے کہ معاملہ Cabinet کے غور کے لیے مناسب Forum نہیں ہے تو وہ اسے وزیراعظم کے سامنے پیش کرنے کا مشورہ دے سکتا ہے یا اسے کسی مناسب Forum کے سامنے پیش کرنے کی ہدایت کر سکتا ہے۔

Procedure regarding circulation of Cabinet cases
(1) جب کسی معاملے پر Cabinet کے وزراء سے circulation کے ذریعے رائے لے کر فیصلہ کیا جائے تو Cabinet Secretariat رائے دینے کی آخری تاریخ مقرر کرے گا۔ اگر کوئی وزیر مقررہ وقت تک اپنی رائے نہیں دیتا تو یہ سمجھا جائے گا کہ وہ Summary میں دی گئی سفارشات سے متفق ہے۔
(2) مقررہ وقت ختم ہونے کے بعد Cabinet Secretariat کو موصول ہونے والی تمام آراء کو فیصلہ کے لیے پیش کیا جائے گا۔ وزیراعظم چاہیں تو معاملے پر Cabinet کے اجلاس میں بحث کی جا سکتی ہے، بصورتِ دیگر وزراء کی آراء کی بنیاد پر معاملہ circulation کے ذریعے نمٹایا جائے گا۔
(3) Cabinet کے فیصلوں پر کی گئی کارروائی کی Supplementary Summary کی صورت میں Cabinet کے سامنے پیش کیا جائے گا۔
(4) Cabinet کا عام اجلاس عموماً ہفتے میں ایک بار وزیراعظم کے مقرر کردہ دن اور وقت پر ہوتا ہے۔ اگر کوئی فوری یا ہنگامی معاملہ ہو تو وزیراعظم کسی بھی وقت Cabinet کا خصوصی اجلاس طلب کر سکتے ہیں۔
(5) Cabinet کے اجلاس میں وفاقی وزراء شرکت کرتے ہیں، جبکہ وزراءِ مملکت، مشیران، خصوصی معاونین اور دیگر اہم افراد کو وزیراعظم ضرورت کے مطابق خصوصی دعوت دے سکتے ہیں۔
(6) اگر کوئی وزیر وزیراعظم سے اجازت لے کر اجلاس میں شریک نہ ہو تو، اگر اس کے Division کا کوئی معاملہ Agenda میں ہو، تو اس Division کا Secretary لازماً اجلاس میں موجود ہوگا۔
(7) وزراء کو اپنے دورے اس طرح ترتیب دینے چاہئیں کہ وہ ہفتہ وار Cabinet کے اجلاس میں شرکت کر سکیں۔
(8) Cabinet کے اجلاس کی صدارت وزیراعظم کرتے ہیں۔ اگر وزیراعظم موجود نہ ہوں تو ان کی طرف سے نامزد وزیر اجلاس کی صدارت کرے گا۔ وزیراعظم اپنی غیر موجودگی میں بھی Cabinet کا اجلاس منعقد کرنے کی اجازت دے سکتے ہیں۔ تاہم، اگر معاملہ انتہائی فوری ہو تو وزیراعظم کی منظوری کے بغیر بھی فوری کارروائی کی جا سکتی ہے۔
(9) Cabinet Secretariat اجلاس سے عام طور پر دو دن پہلے وزراء کو Agenda اور متعلقہ Summaries بھیجتا ہے۔ خصوصی اجلاس میں Agenda دو دن سے کم وقت میں بھی جاری کیا جا سکتا ہے۔
(10) متعلقہ Divisions عام طور پر اجلاس سے دو دن پہلے Cabinet Secretariat کو Working Papers تیار کرکے بھیجیں گے۔ اگر حالات ایسے ہوں کہ تحریری Working Paper تیار کرنا ممکن نہ ہو اور معاملہ فوری کارروائی کا تقاضا کرتا ہو تو وزیراعظم اس شرط کو ختم کر سکتے ہیں۔
(11) جس معاملے کی Summary پہلے وزراء کو نہیں بھیجی گئی ہو، اس پر Cabinet میں بحث نہیں کی جا سکتی، چاہے متعلقہ وزیر بھی اجلاس میں موجود ہو۔
(12) دوسرے افسران عام طور پر Cabinet کے اجلاس میں شریک نہیں ہوتے۔ تاہم، جس Division کا معاملہ Cabinet میں زیرِ بحث ہو، اس Division کا Secretary اجلاس میں موجود رہے گا اور مطلوبہ معلومات فراہم کرے گا۔
(13) اگر کسی معاملے پر تکنیکی یا خصوصی معلومات درکار ہوں، یا متعلقہ وزیر یا Secretary موجود نہ ہو، تو Cabinet Secretariat متعلقہ افسر کو اجلاس میں بلا سکتا ہے۔ ایسا افسر صرف متعلقہ معاملے کے وقت موجود ہوگا اور باقاعدہ بحث شروع ہونے سے پہلے اجلاس سے چلا جائے گا۔
(14) اگر کسی Division کا Secretary یہ سمجھتا ہے کہ وزیر کی واپسی تک معاملے پر بحث مؤخر ہونی چاہیے تو وہ Cabinet Secretariat سے اجلاس ملتوی کرنے کی درخواست کر سکتا ہے۔
(15) وزیراعظم متعلقہ وزیر، Secretary یا متعلقہ افسر سے مطلوبہ فیصلے کے نکات کی وضاحت طلب کر سکتے ہیں۔
(16) Cabinet Secretariat یا Cabinet Division کا مجاز افسر ہر اجلاس میں شرکت کرتا ہے اور دو اہم ریکارڈ تیار کرتا ہے:
(a) بحث کا مختصر ریکارڈ۔
(b) Cabinet کے فیصلوں کا ریکارڈ۔
Cabinet کے فیصلوں کے ریکارڈ میں عام طور پر فیصلے کی وجوہات درج نہیں کی جاتیں۔
(17) Cabinet Secretariat اجلاس کے ریکارڈ کی ایک کاپی 24 گھنٹے کے اندر وزراء کو بھیجتا ہے تاکہ وہ اسے دیکھ کر کسی غلطی یا اہم بات کے رہ جانے کی صورت میں 24 گھنٹے کے اندر Cabinet Secretariat کو مطلع کر سکیں۔
(18) عام ٹائپنگ، کلریکل یا پرنٹنگ کی غلطی کی صورت میں Cabinet Secretariat وزیراعظم کے احکامات حاصل کرکے corrigendum جاری کر سکتا ہے۔ تاہم، اگر غلطی صرف معمولی نوعیت کی ہو اور اس سے اصل مفہوم پر اثر نہ پڑتا ہو تو Cabinet Secretariat خود اسے درست کر سکتا ہے اور اس کے لیے وزیراعظم کی منظوری ضروری نہیں ہوگی۔
(19) Cabinet کے فیصلے متعلقہ Division کو عمل درآمد کے لیے دیے جاتے ہیں۔ اگر کوئی وزیر اجلاس میں موجود نہ ہو لیکن اس کا Secretary اجلاس میں شریک ہو، تو اس Division کے معاملات سے متعلق Cabinet کے فیصلے کی ایک کاپی اس Secretary کو بھیجی جائے گی۔

Procedure regarding National Economic Council
(1) National Economic Council (NEC) کا اجلاس Cabinet Division، وزیراعظم کی ہدایات پر بلاتا ہے اور وزیراعظم اجلاس کی صدارت کرتے ہیں۔
وفاقی اور صوبائی وزراء کو ضرورت کے مطابق NEC کی بحث اور مشاورت میں شامل کیا جا سکتا ہے۔ متعلقہ وفاقی Divisions اور صوبائی حکومتوں کے افسران کو بھی ضرورت کے مطابق اجلاس میں شامل کیا جا سکتا ہے۔
(2) NEC میں معاملات پیش کرنے اور اجلاس کے طریقۂ کار کے لیے Rules 17، 18 اور 20 کے اصول لاگو ہوں گے، تاہم ایک اہم فرق یہ ہے کہ کسی معاملے کا Summary اجلاس شروع ہونے سے کم از کم 5 واضح دن پہلے Cabinet Division تک پہنچ جانا چاہیے۔
(3) Cabinet Secretariat، NEC کو معاملات پیش کرنے کے بارے میں مزید ہدایات جاری کرے گا۔

Procedure regarding Committees of Cabinet and National Economic Council

(6) Cabinet Secretariat بھی Cabinet کے فیصلوں پر عمل درآمد کی نگرانی کرے گا اور متعلقہ Division کے Secretary سے ضرورت کے مطابق مطلوبہ دستاویزات اور معلومات حاصل کرے گا۔
(7) Cabinet Secretariat Cabinet کے فیصلوں کا مکمل ریکارڈ محفوظ رکھے گا، جس میں متعلقہ کاغذات، اجلاس یا circulation کے ذریعے تیار کیے گئے ریکارڈ اور مطلوبہ دستاویزات شامل ہوں گی۔

PART E.—LEGISLATION

Official Bills
(1) متعلقہ Division، Bill کے مقاصد اور اہم نکات طے کرتا ہے۔ پھر Draft Bill کو Law and Justice Division کو بھیجا جاتا ہے تاکہ وہ Bill کا قانونی مسودہ تیار کرے۔ ضرورت پڑنے پر دوسرے متعلقہ Divisions، خصوصاً Finance Division، سے بھی مشاورت کی جاتی ہے۔
(2) Law and Justice Division یہ دیکھتا ہے کہ Parliament کو اس موضوع پر قانون بنانے کا اختیار ہے یا نہیں، اور Bill کا مسودہ تیار کرنے کے لیے کسی قانونی شرط کو پورا کرنا ضروری ہے یا نہیں۔ یہ بھی دیکھا جاتا ہے کہ Federal Government کی رضامندی، سفارش یا President کی پیشگی منظوری درکار ہے یا نہیں۔
(3) اگر Bill تیار کرنے یا پیش کرنے کے لیے Cabinet یا Prime Minister کی منظوری ضروری ہو تو متعلقہ Division اسے منظوری کے لیے Cabinet کے سامنے پیش کرتا ہے۔ اگر کوئی مسئلہ باقی ہو تو اس کا فیصلہ بھی Cabinet کرتی ہے۔
(4) جہاں ضروری ہو، Draft Bill تیار ہونے کے بعد متعلقہ Division اسے دوبارہ Cabinet کے سامنے منظوری کے لیے پیش کرتا ہے۔ President کی پیشگی منظوری درکار ہو تو President کے دستخط حاصل کیے جاتے ہیں۔
(5) متعلقہ Division، Bill کی حتمی شکل Law and Justice Division کے ساتھ مل کر تیار کرتا ہے اور اس کے ساتھ Statement of Objects and Reasons بھی شامل کرتا ہے۔ Law and Justice Division تمام قانونی تقاضے مکمل ہونے کی تصدیق کرتا ہے۔
(6) اس کے بعد متعلقہ Division، Bill کو Parliamentary Affairs Division کو بھیجتا ہے تاکہ اسے National Assembly یا Senate میں مناسب طور پر پیش کیا جا سکے۔

Non-Official Bills
(1) Non-Official Bill کے معاملے میں متعلقہ Division سب سے پہلے یہ دیکھتا ہے کہ Bill کے انتظامی اثرات کیا ہوں گے۔ ضرورت پڑنے پر دوسرے متعلقہ Divisions، خصوصاً Finance Division، سے بھی مشورہ کیا جاتا ہے۔
(2) Law and Justice Division یہ بتاتا ہے کہ Parliament کو اس موضوع پر قانون بنانے کا اختیار ہے یا نہیں، Bill کے لیے کون سی قانونی شرائط پوری کرنا ضروری ہیں، اور آیا Federal Government کی رضامندی یا سفارش یا President کی پیشگی منظوری درکار ہے یا نہیں۔
(3) متعلقہ Division یہ فیصلہ کرتا ہے کہ Bill کے بارے میں National Assembly یا Senate میں کیا موقف اختیار کیا جائے: Bill کو فوراً یا بعد میں زیرِ غور لایا جائے، اسے کسی Committee کے حوالے کیا جائے، عوام یا اراکین کی رائے لینے کے لیے circulation میں بھیجا جائے، یا Bill کی مخالفت کی جائے۔
(4) اس کے بعد Minister-in-Charge اس معاملے میں ضروری منظوری حاصل کرے گا۔
(5) اگر Bill پیش کرنے کے لیے Federal Government کی رضامندی یا سفارش، یا President کی پیشگی منظوری یا دستخط ضروری ہوں تو متعلقہ Division یہ منظوری یا سفارش حاصل کرے گا۔

Official and Non-Official Amendments
(1) Non-Official Amendment کا طریقہ وہی ہوگا جو Non-Official Bill کا ہے، جبکہ Official Amendment کا طریقہ وہی ہوگا جو Official Bill کا ہے۔

Ordinances
(1) Ordinance بنانے کا طریقہ بنیادی طور پر Official Bill کے طریقے جیسا ہوگا۔
(2) اگر Ordinance میں Article 73(2) میں بیان کردہ مالی معاملات شامل ہوں تو اسے National Assembly میں پیش کیا جائے گا، جبکہ اگر ایسے مالی معاملات شامل نہ ہوں تو اسے National Assembly اور Senate دونوں میں پیش کیا جائے گا۔

Compliance with Rules of Majlis-e-Shoora (Parliament)
ہر Division کو پارلیمانی معاملات میں مقررہ قواعد کے مطابق کام کرنا ہوگا۔ قومی اسمبلی، سینیٹ یا دونوں ایوانوں کے مشترکہ اجلاس سے متعلق معاملات میں متعلقہ ایوان کے Rules of Procedure اور Standing Orders کی پابندی کی جائے گی۔

Summoning of Majlis-e-Shoora (Parliament), a House or joint sitting by the President
(1) جب Parliament یا کسی ایوان کا اجلاس بلانے کا وقت ہو تو Parliamentary Affairs Division کا Secretary پہلے یہ معلوم کرے گا کہ National Assembly، Senate یا مشترکہ اجلاس میں کون سے معاملات زیرِ التوا ہیں۔
(2) Rule 15-A کے مطابق صدرِ پاکستان سے اجلاس بلانے کے احکامات حاصل کیے جائیں گے۔
(3) صدر کی منظوری کے بعد اجلاس کی تاریخ، وقت اور جگہ متعلقہ Secretary کو بتائی جائے گی۔
(4) اگر National Assembly کا اجلاس ہو تو National Assembly کے Secretary کو اطلاع دی جائے گی۔
(5) اگر Senate کا اجلاس ہو تو Senate کے Secretary کو اطلاع دی جائے گی۔
(6) اگر دونوں ایوانوں کا مشترکہ اجلاس ہو تو National Assembly اور Senate دونوں کے Secretaries کو اطلاع دی جائے گی۔
(7) سرکاری Gazette میں اجلاس کی تاریخ، وقت اور جگہ کی اطلاع شائع کی جائے گی۔
(8) Gazette میں اطلاع کے بعد:
(a) National Assembly کے اجلاس کا Notification، National Assembly کا Secretary جاری کرے گا۔
(b) Senate کے اجلاس کا Notification، Senate کا Secretary جاری کرے گا۔
(c) مشترکہ اجلاس کا Notification، دونوں Secretaries جاری کریں گے۔

Prorogation of Majlis-e-Shoora (Parliament), a House, or joint sitting by the President
(1) جب National Assembly، Senate یا دونوں ایوانوں کے مشترکہ اجلاس کو Prorogue (اختتام) کرنے کا وقت ہو تو Parliamentary Affairs Division کا Secretary Rule 15-A کے تحت صدرِ پاکستان سے اجلاس ختم کرنے کے احکامات حاصل کرے گا۔
(2) صدر کے احکامات ملنے کے بعد متعلقہ ایوان کے Secretary کو اطلاع دی جائے گی۔
(3) اگر National Assembly کا اجلاس ختم کیا جائے تو National Assembly کے Secretary کو اطلاع دی جائے گی۔
(4) اگر Senate کا اجلاس ختم کیا جائے تو Senate کے Secretary کو اطلاع دی جائے گی۔
(5) اگر دونوں ایوانوں کا مشترکہ اجلاس ختم کیا جائے تو دونوں ایوانوں کے Secretaries کو اطلاع دی جائے گی۔
(6) سرکاری Gazette میں اجلاس ختم ہونے کی تاریخ کی اطلاع شائع کی جائے گی۔
(7) Gazette میں اطلاع کے بعد:
(a) National Assembly کی صورت میں National Assembly کا Secretary Notification جاری کرے گا۔
(b) Senate کی صورت میں Senate کا Secretary Notification جاری کرے گا۔
(c) دونوں ایوانوں یا مشترکہ اجلاس کی صورت میں دونوں Secretaries Notification جاری کریں گے۔

Summoning and prorogation of National Assembly by the Speaker
(1) اگر Speaker، Article 54(3) کے تحت National Assembly کا اجلاس طلب کرتے ہیں تو National Assembly کا Secretary اجلاس کی تاریخ، وقت اور جگہ کا اعلان سرکاری Gazette میں کرے گا۔
(2) اگر Speaker، Article 54(3) کے تحت National Assembly کا اجلاس Prorogue (ختم) کرتے ہیں تو National Assembly کا Secretary اجلاس ختم ہونے کی تاریخ بھی سرکاری Gazette میں شائع کرے گا۔

Summoning and prorogation of the Senate by the Chairman
(1) اگر Chairman، Article 54(3) اور Article 61 کے تحت Senate کا اجلاس طلب کرتے ہیں تو Senate کا Secretary اجلاس کی تاریخ، وقت اور جگہ کا اعلان سرکاری Gazette میں کرے گا۔
(2) اگر Chairman، Senate کا اجلاس Prorogue (ختم) کرتے ہیں تو Senate کا Secretary اجلاس ختم ہونے کی تاریخ بھی سرکاری Gazette میں شائع کرے گا۔

Review of official and non-official business
(1) Parliamentary Affairs Division، National Assembly، Senate یا مشترکہ اجلاس کے بارے میں اجلاس شروع ہونے سے کم از کم 5 دن پہلے سرکاری اور غیر سرکاری کام کی تفصیلی فہرست تمام متعلقہ Divisions کو بھیجے گا۔
(2) متعلقہ Divisions اس فہرست کا جائزہ لیں گے اور ان سرکاری اور غیر سرکاری معاملات کی نشاندہی کریں گے جو National Assembly یا Senate میں پیش کیے جانے ہیں۔
(3) جب National Assembly، Senate یا مشترکہ اجلاس کے بارے میں Notification جاری ہو جائے تو تمام Divisions کے لیے ضروری ہوگا کہ وہ اپنے متعلقہ معاملات کی تفصیلی فہرست Parliamentary Affairs Division کو بھیجیں۔

Provisional forecast of official and non-official business
(1) Parliamentary Affairs Division کا Secretary یہ اندازہ لگائے گا کہ National Assembly، Senate یا مشترکہ اجلاس میں کون کون سے سرکاری اور غیر سرکاری معاملات پیش کیے جانے ہیں۔
(2) اس مقصد کے لیے Leader of the House سے درخواست کی جائے گی کہ ان معاملات کے لیے کون سے دن مقرر کیے جائیں۔
(3) Speaker یا Chairman کی منظوری کے ذریعے، یا مشترکہ اجلاس کی صورت میں وزیراعظم کے ذریعے، مجوزہ شیڈول تیار کیا جائے گا۔
(4) وزیراعظم کے دفتر سے منظوری کے بعد حتمی شیڈول تمام متعلقہ Divisions اور Parliamentary Affairs Division کو بھیج دیا جائے گا۔

Orders of the Day
(1) Parliamentary Affairs Division کا Secretary، Leader of the House سے مشورہ کرکے ہر سرکاری دن کا Orders of the Day، یعنی دن کا Agenda، تیار کرے گا اور متعلقہ Parliamentary Secretary کو بھیجے گا۔
(2) اگر اجلاس National Assembly کا ہو تو Agenda وزیراعظم سے مشورے کے بعد تیار کرکے National Assembly کے Secretary کو بھیجا جائے گا۔
(3) مشترکہ اجلاس کی صورت میں Agenda متعلقہ Secretary کو بھیجا جائے گا۔

Transmission of Bills, etc.
(1) متعلقہ Parliamentary Secretary کی طرف سے Bills اور دیگر Parliamentary معاملات متعلقہ Division کو فوراً بھیجے جائیں گے۔
(2) National Assembly، Senate یا مشترکہ اجلاس میں پیش ہونے والے Bills، Resolutions، Notices، Questions اور دیگر معاملات متعلقہ Division کو بھیجے جائیں گے۔
(3) اگر کوئی Bill یا Parliamentary معاملہ غلطی سے کسی دوسرے Division کو بھیج دیا جائے تو وہ Division اسے صحیح متعلقہ Division کو منتقل کرے گا اور Parliamentary Affairs Division کو بھی اطلاع دے گا۔
(4) متعلقہ Division کو فوراً یہ اطلاع دی جائے گی کہ کسی Bill، Resolution، Motion یا Question کو حتمی طور پر منظور کرکے داخل کیا گیا ہے یا مسترد کیا گیا ہے، تاکہ وہ اس کے مطابق کارروائی کر سکے۔

Action by Divisions
(1) Cabinet Division متعلقہ Secretariat سے یہ معلوم کرے گا کہ مختلف Parliamentary معاملات کس کس Division کے ذمہ ہیں۔
(2) National Assembly یا Senate کے اجلاس سے پہلے ہر Division اپنی کارروائی مکمل کرے گا اور متعلقہ Parliamentary Secretariat کو مطلوبہ معلومات اور دستاویزات فراہم کرے گا۔
(3) جب National Assembly، Senate یا مشترکہ اجلاس سے متعلق کوئی Notice، اطلاع، Bill یا دوسری دستاویز کسی Division کو متعلقہ Secretariat یا کسی دوسرے ادارے سے موصول ہو تو وصول کرنے والا افسر اسے فوراً Secretary اور متعلقہ Minister کے علم میں لائے گا۔

Introduction of Bills, etc.
(1) جب کوئی Bill National Assembly میں پیش کیا جائے گا تو خاص طور پر Money Bill، Finance Bill اور Annual Budget Statement بھی National Assembly میں پیش کیے جائیں گے۔
(2) جب National Assembly کسی Money Bill کو منظور کرے گی تو وہ Bill Senate کو بھیجا جائے گا۔ Senate اس Bill پر غور کرے گا اور اپنی سفارشات National Assembly کو 14 دن کے اندر دے سکتا ہے۔ National Assembly ان سفارشات کو قبول یا مسترد کر سکتی ہے۔
(3) Money Bill کے علاوہ دوسرے Bills، Resolutions، Motions اور Questions، جو Federal Legislative List سے متعلق ہوں، National Assembly یا Senate، دونوں میں سے کسی بھی ایوان میں پیش کیے جا سکتے ہیں۔
(4) تاہم، کسی مخصوص Official Bill یا Motion کو کس ایوان میں پیش کرنا ہے، اس کا فیصلہ وزیراعظم متعلقہ Minister-in-Charge سے مشورہ کرکے کریں گے۔
(5) Official Bill کو National Assembly یا Senate میں Minister-in-Charge یا اس کی طرف سے مجاز کسی دوسرے وزیر کے ذریعے پیش کیا جائے گا۔
(6) Bill پیش ہونے کے بعد متعلقہ Minister، Leader of the House سے مشورہ کرکے فیصلہ کرے گا کہ Bill کے بارے میں کیا کارروائی کی جائے:
(a) اسے فوراً زیرِ غور لا کر منظور کیا جائے؛
(b) کسی مقررہ تاریخ کو زیرِ غور لایا جائے؛
(c) اسے کسی Select Committee کے حوالے کیا جائے؛ یا
(d) اسے ارکان یا متعلقہ افراد کی رائے حاصل کرنے کے لیے circulation میں بھیجا جائے۔
(7) اگر Bill میں اہم پالیسی کا مسئلہ شامل ہو تو اسے وزیراعظم کی ہدایات کے مطابق متعلقہ افراد کی رائے لینے کے لیے گردش (circulation) میں بھیجا جا سکتا ہے۔
(8) متعلقہ Minister کے استعمال کے لیے Official یا Non-Official Bill کے بارے میں ایک مختصر Brief تیار کیا جائے گا۔
(9) آخر میں متعلقہ Division کو Bill کے بارے میں ضروری کارروائی مکمل کرنا ہوگی۔

Assent to Bills
(1) جب کوئی Bill Parliament سے منظور ہونے کے بعد President of Pakistan کی منظوری کے لیے بھیجا جائے گا تو متعلقہ Assembly/Senate Secretariat، Speaker یا Chairman سے تصدیق شدہ (certified) شکل میں اسے Parliamentary Affairs Division کو بھیجے گا۔
(2) Parliamentary Affairs Division اس Bill کو President of Pakistan کے پاس منظوری (Assent) کے لیے پیش کرے گا۔
(3) President کے پاس بنیادی طور پر دو راستے ہوتے ہیں:
(a) منظوری دینا:
President Bill پر Assent دے سکتے ہیں۔
(b) Bill واپس کرنا:
اگر Bill Money Bill نہ ہو تو President اسے دوبارہ غور کے لیے Parliament کو واپس بھیج سکتے ہیں اور President کی طرف سے بتائی گئی ترامیم پر بھی غور کیا جا سکتا ہے۔
42A. Reconsideration of Bill by Majlis-e-Shoora (Parliament)
(1) اگر President کسی Bill کو دوبارہ غور کے لیے Parliament کو واپس بھیج دیں تو Parliament اس Bill پر دوبارہ غور کرے گی۔
(2) اگر Bill کو دونوں ایوانوں کے مشترکہ اجلاس (Joint Sitting) میں دوبارہ غور کے لیے پیش کیا جائے اور دونوں ایوانوں کے موجود اور ووٹ دینے والے ارکان کی اکثریت سے منظور کر لیا جائے تو اسے Constitution کے مطابق دونوں ایوانوں سے منظور شدہ سمجھا جائے گا۔
(3) اگر President دوبارہ غور کے بعد منظور کیے گئے Bill پر 10 دن کے اندر Assent نہ دیں تو President کو 10 دن کے اندر اس پر منظوری دینی ہوگی۔
(4) اگر President مقررہ 10 دن کے اندر Assent نہیں دیتے تو Bill پر Assent دیا گیا تصور کیا جائے گا (deemed assent)۔
(5) اس کے بعد Bill دوبارہ President کو منظوری کے لیے پیش کیا جائے گا۔

Resolutions
(1) Official Resolution:
جب کوئی سرکاری قرارداد National Assembly، Senate یا Joint Sitting میں پیش کی جانی ہو تو متعلقہ Division، اگر وقت ہو، پہلے Law and Justice Division سے مشورہ کرے گا۔ اس کے بعد وزیر کے دستخط شدہ Notice کے ساتھ قرارداد متعلقہ Parliamentary Secretariat کو بھیجی جائے گی۔
(2) اگر وزیراعظم Cabinet کے اجلاس میں موجود نہ تھے یا وقت کی کمی کی وجہ سے Cabinet سے مشورہ حاصل نہ کیا جا سکا ہو تو Parliament کو قرارداد بھیجنے سے پہلے وزیراعظم کو ضرور دکھایا جائے گا۔
(3) Official Resolution کی مثالوں میں کسی ادارے کا قیام، کسی بین الاقوامی Convention کی توثیق یا کسی قانون کا اعلان شامل ہو سکتا ہے۔ عوامی مفاد کے کسی معاملے پر حکومتی پالیسی کا اعلان بھی Official Resolution کے ذریعے کیا جا سکتا ہے۔
(4) Non-Official Resolution:
جب کوئی غیر سرکاری قرارداد Parliamentary Secretariat سے متعلقہ Division کو موصول ہو تو Division اس کے مندرجات کا جائزہ لے گا۔
(5) اگر قرارداد پر بحث کی اجازت مل جائے تو Division یہ بھی دیکھے گا کہ قرارداد پر بحث کرنے سے وزیراعظم کے احکامات یا عوامی مفاد کو نقصان تو نہیں ہوگا۔ اگر نقصان کا خدشہ ہو تو Division اپنی رائے میں اس کی وجوہات بھی بیان کرے گا۔
(6) اگر معاملہ ایسا ہو جس کے لیے وزیراعظم یا Cabinet کے احکامات یا منظوری ضروری ہو تو متعلقہ Division وزیراعظم یا Cabinet سے ضروری رائے اور احکامات حاصل کرے گا۔
(7) Official اور Non-Official Resolution کے لیے متعلقہ Division، وزیر کے استعمال کے لیے ایک مختصر Brief تیار کرے گا۔
(8) جب قرارداد منظور (adopt) ہو جائے تو متعلقہ Parliamentary Secretariat اسے متعلقہ Division کو بھیجے گا تاکہ اس پر ضروری کارروائی کی جا سکے۔

Motions
(1) Official Motion:
جب کوئی سرکاری تحریک Assembly یا Senate میں پیش کی جانی ہو تو متعلقہ Division اسے Notice کے ساتھ Minister-in-Charge کو بھیجے گا۔ وزیر اس پر دستخط کرنے کے بعد اسے متعلقہ Parliamentary Secretariat کو بھیجے گا۔
(2) Official Motion کسی معاملے پر بحث شروع کرنے، کسی Standing Committee کے قیام یا قانونی ادارے کے اراکین کے انتخاب وغیرہ کے لیے ہو سکتی ہے۔
(3) Non-Official Motion:
جب کوئی غیر سرکاری تحریک Parliamentary Secretariat سے متعلقہ Division کو موصول ہو تو متعلقہ Division یہ دیکھے گا کہ اس پر بحث کرنا عوامی مفاد کے خلاف تو نہیں۔
(4) اگر تحریک یا اس کا کوئی حصہ عوامی مفاد کے خلاف ہو تو متعلقہ Division اسے Cabinet کے سامنے پیش کرے گا اور اپنی وجوہات بھی بتائے گا۔
(5) ہر Official یا Non-Official Motion ایسا معاملہ ہو جس کے لیے وزیراعظم یا Cabinet کی منظوری ضروری ہو تو متعلقہ Division تحریک منظور ہونے کے فوراً بعد معاملہ وزیراعظم یا Cabinet کے سامنے پیش کرے گا۔
(6) تحریک منظور ہونے کے بعد متعلقہ Parliamentary Secretariat اسے مزید کارروائی کے لیے متعلقہ Division کو بھیج دے گا۔
(7) متعلقہ Division، Non-Official Motion کے بارے میں وزیر کے لیے ایک مختصر Brief تیار کرے گا۔

Questions
(1) جب Assembly یا Senate کے متعلقہ Secretariat سے کسی رکن کا Starred، Un-starred یا Short Notice Question متعلقہ Division کو موصول ہو تو Division اس سوال کا جواب تیار کرے گا۔

Budget
(1) Budget کے لیے متعلقہ Secretariat تمام متعلقہ Divisions اور وزیراعظم کے دفتر کے Secretariat کو Timetable تیار کرکے بھیجے گا۔
