NOTIFICATION
S.R.O. 432(I)/2004.- In exercise of the powers conferred by section 26 of the Public Procurement Regulatory Authority Ordinance, 2002 (XXII of 2002), the Federal Government is pleased to make the following rules, namely:-

Short title and commencement.-
(1) These rules may be called the Public Procurement Rules, 2004.
(2) They shall come into force at once.

General Provisions and Definitions
ان قواعد میں، جب تک کہ موضوع یا سیاق و سباق میں کوئی بات منافی نہ ہو،
(الف) “Bid” (بڈ) سے مراد کسی شخص، فرم، مشیر، کمپنی یا تنظیم کی طرف سے کسی مخصوص کام کو انجام دینے کی رضامندی کی قیمت کے طور پر دی گئی پیشکش یا کسی دعوت کے جواب میں دی گئی پیشکش ہے؛
(ب) “Bidder” (بڈر) سے مراد وہ شخص ہے جو بڈ جمع کراتا ہے؛
(ب*) “Blacklisted” (بلیک لسٹ) سے مراد ایسا بڈر ہے جسے اتھارٹی نے اس حقیقت کے تعین کے بعد کہ وہ بدعنوانی اور فراڈ کی کسی مشق یا مشقوں میں ملوث پایا گیا تھا، ناقابل اعتبار قرار دیا ہو؛ یا اسے اتھارٹی کی طرف سے کارکردگی کی ناکامی کی وجہ سے نااہل قرار دیا گیا ہو؛ یا اگر بڈر نے معاہدے پر عمل درآمد کے دوران طے شدہ کارکردگی سے انحراف کیا ہو، یا اپنے بڈ یا تجویز کے حوالے سے پہلے جمع کرائی گئی معلومات سے انحراف کیا ہو؛
(ب) “Call off order” (کال آف آرڈر) سے مراد وہ آرڈر ہے جو کسی پروکیورنگ ایجنسی کے ذریعے فریم ورک معاہدے کے تحت اشیاء کی ایک رینج کے بارے میں طے شدہ شرائط و قیمتوں کے تحت دیا جاتا ہے، جس میں شرائط پر دوبارہ بات چیت کرنے کی ضرورت نہیں ہوتی؛
(ب*) “Closed framework agreement” (کلوزڈ فریم ورک ایگریمنٹ) سے مراد طے شدہ شرائط و ضوابط اور طے شدہ قیمت کے ساتھ ایک معاہدہ ہے؛
(ج) “Competitive bidding” (مسابقتی بڈنگ) سے مراد معاہدہ دینے کا ایسا طریقہ کار ہے جس کے ذریعے تمام دلچسپی رکھنے والے افراد، فرموں، کمپنیوں یا تنظیموں کو شرکت کا موقع دیا جاتا ہے؛ اس میں قومی مسابقتی بڈنگ اور بین الاقوامی مسابقتی بڈنگ دونوں شامل ہیں؛
(د) “Contractor” (کنٹریکٹر) سے مراد ایسا شخص، فرم، مشیر، کمپنی یا تنظیم ہے جو اشیاء، خدمات یا تعمیراتی کام فراہم کرنے کی ذمہ داری لیتا ہے؛
(ہ) “Contract” (معاہدہ) سے مراد قانون کے تحت قابلِ نفاذ معاہدہ ہے؛
(و) “Corrupt and fraudulent practices” (بدعنوانی اور فراڈ پر مبنی مشقیں) سے مراد درج ذیل ایک یا کوئی مجموعہ بھی ہے:
(i) “Coercive practices” (زبردستی کی مشقیں): کسی فریق کو متاثر کرنے یا غلط فائدہ حاصل کرنے کے لیے دوسرے فریق کو براہِ راست یا بالواسطہ نقصان پہنچانا یا اس کی جائیداد کو نقصان پہنچانے کی دھمکی دینا؛
(ii) “Collusive practices” (ملی بھگت کی مشقیں): تدارک کے عمل میں دو یا دو سے زیادہ فریقوں کے درمیان ایسا انتظام جس کا مقصد کسی غلط فائدے کے لیے کھلی مسابقت کو دبانا یا غیر مسابقتی سطح پر مصنوعی قیمتیں طے کرنا ہو؛
(iii) “Corrupt practices” (بدعنوانی کی مشقیں): کسی دوسرے فریق کے اعمال کو غلط فائدے کے لیے متاثر کرنے کے لیے براہِ راست یا بالواسطہ کسی قیمتی چیز کی پیشکش، دینا، وصول کرنا یا اس کا مطالبہ کرنا؛
(iv) “Fraudulent practices” (فراڈ پر مبنی مشقیں): کسی دوسرے فریق سے مالی یا کسی دوسرے فائدے کے حصول یا کسی ذمہ داری سے بچنے کے لیے جان بوجھ کر یا لاپرواہی سے اسے گمراہ کرنا یا گمراہ کرنے کی کوشش کرنا، جس میں غلط بیانی، کسی فعل یا کوتاہی بھی شامل ہے؛
(v) “Obstructive practices” (رکاوٹ ڈالنے والی مشقیں): تدارک کے عمل میں شرکت کو متاثر کرنے یا کسی معاہدے کے نفاذ کو متاثر کرنے کے لیے افراد کو براہِ راست یا بالواسطہ نقصان پہنچانا یا نقصان پہنچانے کی دھمکی دینا؛
(ف) “Cross debarred” (کراس ڈیبَرڈ) سے مراد یہ ہے کہ کسی پروکیورنگ ایجنسی کی طرف سے نااہل قرار دیا گیا بڈر تمام پروکیورنگ ایجنسیوں کی طرف سے نااہل تصور کیا جائے گا؛
(ز) “Emergency” (ہنگامی صورتِ حال) سے مراد قدرتی آفات، حادثات، جنگ اور آپریشنل ایمرجنسی ہے، جو ایسی غیر معمولی صورتِ حال کو جنم دے سکتی ہے جس کے لیے جان و مال یا ماحول کو نقصان سے بچانے یا محدود کرنے کے لیے فوری اور مؤثر کارروائی کی ضرورت ہو؛
(گ) “E-procurement” (ای-پروکیورمنٹ) سے مراد تدارک کے عمل کے لیے کمیونیکیشن ٹیکنالوجیز، ڈیجیٹل یا الیکٹرانک ذرائع کا استعمال ہے؛
(گ*) “Force account” (فورس اکاؤنٹ) سے مراد کسی سرکاری ملکیت والے ادارے کے ساتھ براہِ راست کنٹریکٹ کے ذریعے تدارک ہے، جس میں چھوٹے کاموں اور غیر مشاورتی خدمات کا نفاذ شامل ہو؛
(ج*) “Framework agreement” (فریم ورک معاہدہ) سے مراد ایسا معاہداتی انتظام ہے جو کسی پروکیورنگ ایجنسی کو ایک ہی ذمہ داری انجام دینے کے لیے ایک سے زیادہ آرڈرز کے ذریعے وسائل فراہم کرنے کی اجازت دیتا ہے، بشرطیکہ اس کی لاگت اور وقت کے لحاظ سے مؤثر ہونے کی تصدیق کر لی جائے؛
(ح) “Most advantageous bid” (سب سے زیادہ فائدہ مند بڈ) سے مراد:
(i) ایسی بڈ یا تجویز جو درخواستِ بڈنگ یا تجاویز کی دستاویزات میں طے شدہ شرائط و ضوابط کے مطابق ہو اور مطلوبہ اہلیت یا معیار پر پورا اترتی ہو؛ اور
(ii) ایسی بڈ یا تجویز جو لاگت، معیار، اہلیت یا ان کے کسی مجموعے کی بنیاد پر، جیسا کہ درخواستِ بڈنگ یا تجاویز کی دستاویزات میں بتایا گیا ہو، پروکیورنگ اتھارٹی کی طرف سے جاری کیے جانے والے تکنیکی انتخاب کے مطابق ہو؛
(ح*) “Open framework agreement” (اوپن فریم ورک معاہدہ) سے مراد طے شدہ شرائط و ضوابط کے بغیر طے شدہ قیمت کا معاہدہ ہے؛
(ط) “Ordinance” (آرڈیننس) سے مراد پبلک پروکیورمنٹ ریگولیٹری اتھارٹی آرڈیننس، 2002 (XXII آف 2002) ہے؛
(ط*) “Procurement assignment” (پروکیورمنٹ اسائنمنٹ) سے مراد سامان، کاموں، خدمات کے حصول اور/یا عوامی اثاثوں کی تلفی کے لیے پروکیورنگ ایجنسی کی طرف سے کسی عوامی شعبے کے ادارے کو ایسے تدارک کے افعال تفویض کرنا ہے؛
(ی) “Repeat orders” (ریپیٹ آرڈرز) سے مراد مسابقت کے بغیر ایک ہی ذریعے سے اسی شے کا تدارک ہے اور اس میں معاہدوں میں اضافہ بھی شامل ہے؛
(ک) “Supplier” (سپلائر) سے مراد ایسا شخص، فرم، مشیر، کمپنی یا تنظیم ہے جو اشیاء یا کام فراہم کرنے کی ذمہ داری لیتا ہے؛
(ک*) “Unsolicited project proposal” (غیر مطلوبہ پروجیکٹ کی تجویز) سے مراد ایسی تجویز ہے جس میں ایک منفرد اور جدید خیال شامل ہو اور وہ تدارک کے طریقۂ کار میں ہو، اور جو پروکیورنگ ایجنسی کے مشن اور مقاصد سے ہم آہنگ ہو، تاہم درخواستِ تجاویز کے جواب میں پیش نہ کی گئی ہو اور جوابی تجاویز طلب کر کے تجویز کنندہ کے تکنیکی اور مالی پہلوؤں کو چیلنج کرنے کے لیے مسابقتی انتخاب کے عمل سے مشروط ہو؛
(ل) “Value for money” (ویلیو فار منی) سے مراد پروکیورنگ ایجنسی کی ضروریات کو پورا کرنے کے لیے معیار، لاگت، سروس، اپ گریڈنگ کے بعد از فروخت خدمات، وقت کی پابندی اور دیگر متعلقہ عوامل کے مجموعے کے لحاظ سے خرچ کیے گئے ہر روپے کا بہترین فائدہ ہے۔

جانچ کے معیار بڈنگ دستاویزات کا لازمی حصہ ہوں گے اور قواعد کی مقررہ شرائط و ضوابط کے مطابق ہوں گے۔

(1) تمام بڈز کی جانچ بڈنگ دستاویزات میں مقرر کردہ معیار اور دیگر طے شدہ شرائط و ضوابط کے مطابق کی جائے گی۔
(2) مختلف کرنسیوں میں کوٹ کی گئی بڈز کے موازنے کے مقاصد کے لیے کسی بھی بڈ کی جانچ کے لیے ایسا معیار استعمال نہیں کیا جائے گا جو بڈنگ دستاویزات میں مخصوص نہ کیا گیا ہو۔
کرنسی کو ایک ہی کرنسی میں تبدیل کیا جائے گا، جیسا کہ بڈز کھولنے کی مخصوص تاریخ کو اسٹیٹ بینک آف پاکستان کی مروجہ فروخت کی شرح (Selling Rate) ہوگی۔

(1) بڈز کھولنے کے بعد کسی بھی بولی دہندہ کو اپنی بڈ میں تبدیلی یا ترمیم کرنے کی اجازت نہیں ہوگی۔
تاہم، پروکیورنگ ایجنسی بڈ کی وضاحت طلب کر سکتی ہے۔
(2) پروکیورنگ ایجنسی کی طرف سے بڈ میں وضاحت کے لیے کی جانے والی کوئی بھی درخواست لازماً تحریری ہوگی۔
ایسی درخواست کا جواب بھی تحریری طور پر دیا جائے گا اور ایسا جواب قبول کیا جا سکتا ہے جو بڈ کے بنیادی مواد کو تبدیل نہ کرتا ہو۔

مشکل اور امتیازی شرائط (Difficult and Discriminatory Conditions)
جب تک کہ بصورتِ دیگر فراہم نہ کیا گیا ہو، پروکیورنگ ایجنسی کوئی ایسی شرط متعارف نہیں کرائے گی جو بولی دہندگان کے درمیان امتیاز پیدا کرے یا جسے پورا کرنا مشکل سمجھا جائے۔
کسی شرط کی نوعیت مشکل یا امتیازی ہونے کا تعین کرنے کے لیے تجارت، مینوفیکچرنگ، تعمیراتی کاروبار یا خدمات کے عمومی طریقوں سے رجوع کیا جائے گا، خاص طور پر ان طریقوں سے جو متعلقہ پروکیورمنٹ سے مخصوص طور پر متعلق ہوں۔

بڈز کی مستردگی (Rejection of Bids)
(1) پروکیورنگ ایجنسی کسی بھی وقت کسی بڈ یا تجویز کی قبولیت سے پہلے تمام بڈز یا تجاویز کو مسترد کر سکتی ہے۔
(2) پروکیورنگ ایجنسی بڈز یا تجاویز کو مسترد کرنے کی وجوہات سے تمام بولی دہندگان یا سپلائرز/کنٹریکٹرز کو فوری طور پر آگاہ کرے گی، تاہم اسے ان وجوہات کا جواز پیش کرنے کی پابند نہیں ہوگی۔
(3) تمام بڈز یا تجاویز کی مستردگی کا نوٹس تمام جمع کرانے والے سپلائرز یا کنٹریکٹرز کو فوری طور پر دیا جائے گا۔ کسی بھی سپلائر یا کنٹریکٹر کی طرف سے بڈ یا تجویز جمع کرانے کی وجہ سے پروکیورنگ ایجنسی پر کسی قسم کی ذمہ داری عائد نہیں ہوگی۔

دوبارہ بڈنگ (Re-Bidding)
(1) اگر پروکیورنگ ایجنسی نے قاعدہ 33 کے تحت تمام بڈز مسترد کر دی ہوں تو وہ دوبارہ بڈنگ (Re-Bidding) کی دعوت دے سکتی ہے۔
(2) پروکیورنگ ایجنسی پہلے مسترد کیے جانے کی وجوہات کا جائزہ لے گی اور ضرورت کے مطابق وضاحتیں، جانچ کے معیار یا بولی دہندگان کے لیے کوئی دوسری شرط نظرِ ثانی کر سکتی ہے۔

جانچ کی رپورٹس کا اعلان (Announcement of Evaluation Reports)
پروکیورنگ ایجنسی متعلقہ پروکیورمنٹ کے لیے اختیار کیے گئے طریقہ کار کی بنیاد پر بڈز کی جانچ کے نتائج کا حتمی اعلان ایک رپورٹ کی شکل میں کرے گی۔
جہاں مالی تجاویز کو تکنیکی تجاویز سے الگ جانچنا ہو، وہاں مالی تجاویز کھولنے سے کم از کم پندرہ دن پہلے بڈز کی قبولیت یا مستردگی کی وجوہات فراہم کی جائیں گی۔

ان قواعد میں بصورتِ دیگر فراہم کردہ طریقے کے علاوہ، اوپن مسابقتی بڈنگ کے لیے درج ذیل طریقے قابلِ قبول ہوں گے:
(a) سنگل اسٹیج – ون لفافہ طریقہ (Single Stage – One Envelope Procedure)
(b) سنگل اسٹیج – ٹو لفافہ طریقہ (Single Stage – Two Envelope Procedure)
(i) بڈ ایک ہی پیکج میں ہوگی جس میں دو الگ الگ لفافے ہوں گے۔
(ii) الجھن سے بچنے کے لیے لفافوں پر واضح اور نمایاں حروف میں “TECHNICAL PROPOSAL” اور “FINANCIAL PROPOSAL” لکھا جائے گا۔

ایسی کوئی بھی تجویز جو مقررہ ضروریات کے مطابق نہ ہو، مسترد کر دی جائے گی۔

شرائط کے استعمال کے طریقہ کار کے Open Competitive Bidding
Single Stage – One Envelope، Single Stage – Two Envelope اور Two Stage – Two Envelope کے طریقہ کار درج ذیل حالات میں مناسب طور پر استعمال کیے جائیں گے:
(a) Single Stage – One Envelope Bidding Method:
جہاں bids کی تکنیکی اور مالی evaluation ایک ہی مرحلے میں کی جانی ہو، وہاں Single Stage – One Envelope Bidding Method استعمال کیا جائے گا۔
(b) Single Stage – Two Envelope Bidding Method:
یہ طریقہ ان حالات میں استعمال کیا جائے گا جہاں:
(i) ایک ہی package میں دو الگ الگ envelopes ہوں گے، جن میں technical proposal اور financial proposal الگ الگ ہوں گے۔
(ii) الجھن سے بچنے کے لیے envelopes پر واضح اور جلی حروف میں “TECHNICAL PROPOSAL” اور “FINANCIAL PROPOSAL” لکھا جائے گا۔
(iii) ابتدائی طور پر صرف “TECHNICAL PROPOSAL” کھولا جائے گا۔
(iv) “FINANCIAL PROPOSAL” والا envelope بغیر کھولے Procurement Agency کی تحویل میں رکھا جائے گا۔
(v) Technical proposal کی evaluation کے دوران کسی بھی bid میں ترمیم کی اجازت نہیں ہوگی۔
(vi) Procurement Agency، technical requirements کے حوالے سے bidders سے بات چیت کر سکتی ہے۔
(vii) جن bidders کی technical proposals Procurement Agency کی revised technical requirements کے مطابق ہوں گی، انہیں اپنی technical proposals میں ترمیم کرنے کی اجازت دی جائے گی۔
(viii) دوسرے مرحلے میں ان bidders کو جن کی bids پہلے مسترد نہیں کی گئی ہوں گی اور جو revised technical proposal کے مطابق کارروائی کرنے کے خواہش مند ہوں گے، technical revised proposal اور financial proposal جمع کرانے کی اجازت دی جائے گی۔
(ix) Procurement Agency کی جانب سے مقررہ تاریخ، وقت اور مقام پر financial proposal کھولے جائیں گے، بشرطیکہ bidders کو مناسب وقت دیا جائے تاکہ وہ technical proposal میں متفقہ تبدیلیوں کو شامل کر سکیں اور مطلوبہ supplementary financial proposal تیار کر سکیں۔
(x) Procurement Agency مکمل proposals کی evaluation مقررہ evaluation criteria کے مطابق کرے گی اور سب سے زیادہ advantageous bid منتخب کی جائے گی۔
(c) Two Stage Bidding Method:
مرحلہ اول:
(i) Bidders کی جانب سے قیمت کے بغیر، مطلوبہ specifications کے مطابق صرف technical proposals جمع کرائی جائیں گی۔ سب سے زیادہ advantageous bid پائی جانے والی proposal قبول کی جائے گی۔
(ii) Technical specifications کے بارے میں کسی خامی یا غیر تسلی بخش حصے پر bidders کے ساتھ بات چیت کی جائے گی۔
(iii) Technical proposal کی evaluation مقررہ evaluation criteria کے مطابق کی جائے گی۔
(iv) Procurement Agency کی technical requirements پوری کرنے کے لیے تمام bidders کو اپنی متعلقہ technical proposals میں ترمیم کرنے کی اجازت دی جا سکتی ہے، بشرطیکہ اس طرح کی ترامیم، حذف، اضافے یا تبدیلیاں اس معاملے میں نئی requirements یا criteria شامل نہ کریں جو ان قواعد سے متصادم ہوں۔
قومی competitive bidding کی صورت میں اس طرح کی مزید اجازت دی جا سکتی ہے، بشرطیکہ bidders کو اپنی revised bids تیار کرنے کے لیے کافی وقت دیا جائے اور تمام bidders کو یکساں طور پر مطلع کیا جائے۔
(v) Procurement Agency کی technical requirements کے مطابق اپنی bids میں تبدیلی کرنے کے خواہش مند bidders کو revised bids تیار کرنے کے لیے کافی وقت دیا جائے گا، جو قومی competitive bidding کے معاملے میں پندرہ دن اور بین الاقوامی competitive bidding کے معاملے میں تیس دن سے کم نہیں ہوگا۔
(vi) وہ bidders جن کی technical proposals یا bids مسترد نہیں کی گئی ہوں گی اور جو اپنی bids میں ترمیم کرنے پر رضامند ہوں گے، انہیں بغیر bid security ضبط کیے bidding سے دستبردار ہونے کی اجازت دی جا سکتی ہے۔
(vii) ایسے bidders کو revised technical proposal کے ساتھ financial proposal جمع کرانے کی دعوت دی جائے گی۔
(viii) Revised technical proposal اور financial proposal کی evaluation اوپر بیان کردہ طریقے کے مطابق کی جائے گی اور سب سے زیادہ advantageous bid منتخب کی جائے گی۔
(d) Two Stage – Two Envelope Bidding Method:
مرحلہ اول:
(i) ایک ہی package میں دو الگ الگ envelopes ہوں گے، جن میں technical proposal اور financial proposal الگ الگ ہوں گے۔
(ii) الجھن سے بچنے کے لیے envelopes پر واضح اور جلی حروف میں “TECHNICAL PROPOSAL” اور “FINANCIAL PROPOSAL” لکھا جائے گا۔
(iii) ابتدائی طور پر bidders کو صرف proposals تیار کرنے کا وقت دیا جائے گا۔
(iv) “TECHNICAL PROPOSAL” والا envelope کھولا جائے گا۔
(v) “FINANCIAL PROPOSAL” والا envelope بغیر کھولے Procurement Agency کی تحویل میں رکھا جائے گا۔
(vi) Procurement Agency کی technical requirements پوری کرنے کے خواہش مند bidders کے ساتھ technical proposal کے حوالے سے بات چیت کی جائے گی۔
(vii) Technical requirements پر Procurement Agency اور bidders کے درمیان اتفاق کے بعد bidders کو اپنی technical proposals میں ترمیم کرنے کی اجازت دی جائے گی۔
مرحلہ دوم:
(viii) جن bidders کی bids پہلے مسترد نہیں کی گئی ہوں گی اور جو technical revised proposal کے مطابق کارروائی کرنے کے خواہش مند ہوں گے، وہ revised technical proposal اور supplementary financial proposal جمع کرائیں گے۔
(ix) Supplementary financial proposal کو اصل financial proposal اور revised technical proposal کے ساتھ، Procurement Agency کی طرف سے پہلے سے مطلع کردہ مقررہ تاریخ، وقت اور مقام پر کھولا جائے گا، بشرطیکہ bidders کو متفقہ تبدیلیوں کو اپنی technical proposal میں شامل کرنے اور supplementary financial proposal تیار کرنے کے لیے کافی وقت دیا جائے۔
(x) Procurement Agency proposals کی مکمل evaluation مقررہ evaluation criteria کے مطابق کرے گی اور سب سے زیادہ advantageous bid منتخب کی جائے گی۔
الف۔ غیر مطلوبہ تجاویز (Unsolicited Proposal)
(1) کسی بھی فرد یا سرکاری یا نجی ادارے کی طرف سے Procurement Agency کو موصول ہونے والی کسی بھی unsolicited proposal پر Procurement Agency اس proposal کی viability کا تعین کرے گی۔
یہ proposal ایک Evaluation Committee کی طرف سے جانچی جائے گی، جس میں کم از کم تین technical experts شامل ہوں گے۔
(a) اگر Procurement Agency unsolicited proposal کے بارے میں جانتی ہے تو اس کے بانی کا نام ظاہر کیے بغیر اس proposal کے لیے open competition کا اشتہار دے گی۔
(b) Procurement Agency Evaluation Committee کے ذریعے viability assessment کرے گی۔
(c) Procurement Agency unsolicited proposal کے بانی کو pre-feasibility assessment دے گی۔
(d) اس proposal کے مشترکہ جائزے میں project sponsor کو پانچ فیصد اضافی رعایت دی جائے گی۔
(2) اگر اشتہار کے جواب میں کوئی دوسرا bidder bid جمع نہیں کراتا تو Procurement Agency اپنی bid کو سب سے زیادہ advantageous قرار دے سکتی ہے۔
(3) اگر competitive bidding کے عمل میں proposal کا بانی سب سے زیادہ advantageous bidder کے طور پر سامنے نہیں آتا تو Procurement Agency اس proposal کے بانی کو contract دے سکتی ہے۔
(4) تاہم، اگر proposal کا بانی اس proposal کے ساتھ مطابقت پیدا کرنے کے challenge کو قبول نہیں کرنا چاہتا تو اسے bid کے برابر ہونے کا موقع دیا جائے گا، بشرطیکہ Procurement Agency اسے سب سے زیادہ advantageous bid حاصل کرنے کے لیے مناسب سمجھے۔

Alternative Procurement Methods — پروکیورمنٹ کے متبادل طریقے
پروکیورنگ ایجنسی مال، خدمات اور تعمیراتی کاموں کی پروکیورمنٹ کے لیے درج ذیل متبادل طریقے استعمال کر سکتی ہے:
(a) Petty Purchases — چھوٹی خریداری (پیٹی پرچیزز) پروکیورنگ ایجنسی جہاں قابل اطلاق ہو، بولی یا کوٹیشن کا سہارا لیے بغیر، ایک لاکھ (1,00,000) پاکستانی روپے کی مالیاتی حد تک سنگل کوٹیشن کے ذریعے چھوٹی خریداریوں کا انتظام کر سکتی ہے۔
(b) Request for Quotations — کوٹیشنز کی درخواست پروکیورنگ ایجنسی کوٹیشنز کی درخواست کے ذریعے پروکیورمنٹ شروع کر سکتی ہے جہاں: (i) پروکیورمنٹ کی مالیت ایک لاکھ (1,00,000) پاکستانی روپے سے زیادہ ہو لیکن پانچ لاکھ (5,00,000) پاکستانی روپے سے زیادہ نہ ہو؛
(ii) خریداری کی جانے والی چیز کے معیاری مواصفات (Standard specifications) دستیاب ہوں؛
(iii) کم از کم تین مجاز ڈیلرز، مینوفیکچررز یا اوریجنل ایکوپمنٹ مینوفیکچررز (OEM) سے کوٹیشنز مانگی گئی ہوں؛ اور
(iv) کم از کم تین کوٹیشنز حاصل ہو چکی ہوں۔
پروکیورنگ ایجنسی سب سے کم قیمت پیش کرنے والے سپلائر سے سامان خریدے گی، بشرطیکہ سپلائر مطلوبہ شرائط پر پورا اترتا ہو۔
(c) Direct Contracting — ڈائریکٹ کانٹریکٹنگ پروکیورنگ ایجنسی مناسب جواز کے ساتھ ڈائریکٹ کانٹریکٹنگ کا سہارا لے سکتی ہے جہاں کوٹیشنز کی درخواست کے لیے مقرر کردہ مالیاتی حد کاموں کو انجام دینے کے لیے نا کافی سمجھی جائے۔
ڈائریکٹ کانٹریکٹنگ کا استعمال وہاں کیا جا سکتا ہے جہاں: (i) پروکیورمنٹ براہ راست اصل مینوفیکچرر یا سپلائر سے متعلق ہو؛
(ii) مطلوبہ پروکیورمنٹ کے لیے صرف ایک ہی مینوفیکچرر یا سپلائر دستیاب ہو اور کوئی متبادل ذریعہ موجود نہ ہو؛
(iii) جہاں سپلائر کی تبدیلی کے لیے مختلف تکنیکی مواصفات یا اضافی پرزہ جات یا خدمات کی ضرورت ہو اور اس کے نتیجے میں کسی ملکیتی چیز (Proprietary object) کی پروکیورمنٹ ہوتی ہو؛
(iv) کانٹریکٹ یا کانٹریکٹس کی مدت تین سال سے زیادہ نہ ہو اور مطلوبہ جواز فراہم کیا گیا ہو؛
(v) ہنگامی صورتحال (Emergency) موجود ہو، بشرطیکہ ضروری منظوری حاصل کی گئی ہو؛
(vi) حکومت، مجاز ایجنسی یا کسی دوسرے بااختیار ادارے کی طرف سے مقرر کردہ قیمت پر سامان، خدمات یا کام کی ضرورت ہو؛
(vii) اصل مینوفیکچررز یا ان کے مجاز ایجنٹوں سے پروکیورمنٹ کی ضرورت ہو، بشرطیکہ قیمت مینوفیکچرر کی قیمت کے 15 فیصد سے زیادہ نہ ہو۔
(d) Negotiated Tendering — مذاکراتی ٹینڈرنگ یہ طریقہ صرف اس وقت استعمال کیا جا سکتا ہے جب: (i) انتہائی مخصوص سپلائز (Highly specialized supplies) صرف کسی خاص تحقیق، تجرباتی یا خصوصی ترقیاتی منصوبے کے لیے، یا خاص طور پر تیار کی گئی گاڑیوں کے لیے درکار ہوں؛
(ii) تکنیکی، فنکارانہ یا حقوقِ دانش (Intellectual Property Rights) کی وجہ سے صرف ایک مخصوص سپلائر کے ذریعہ ہی سامان تیار یا فراہم کیا جا سکتا ہو؛
(iii) پروکیورنگ ایجنسی کے کنٹرول سے باہر شدید ہنگامی صورتحال یا غیر متوقع واقعات کی وجہ سے اوپن اور لمیٹڈ بولی کے طریقوں کی عام حدیں پوری نہ کی جا سکتی ہوں۔
(e) Force Account — فورس اکاؤنٹ پروکیورنگ ایجنسی ‘فورس اکاؤنٹ’ کا استعمال کر سکتی ہے بشرطیکہ اس کی وجوہات اور جواز تحریری طور پر محفوظ کیے جائیں۔
اس کا استعمال وہاں کیا جا سکتا ہے جہاں: (i) درکار کام چھوٹے، بکھرے ہوئے یا دور دراز کے علاقوں میں ہوں، اور پروکیورمنٹ کی مالیت بیس کروڑ (200,000,000) پاکستانی روپے سے زیادہ نہ ہو؛
(ii) جاری آپریشنز کو متاثر کیے بغیر قومی ورثے کی فوری مرمت، بحالی یا تجدید کاری کرنا ضروری ہو؛
(iii) اہل تعمیراتی فرموں سے بولیاں حاصل کرنے کا کوئی معقول امکان نہ ہو؛
(iv) شدید ہنگامی صورتحال میں جہاں پرائیویٹ ٹھیکیداروں کے مقابلے میں کسی سرکاری ادارے کے ذریعے خطرے (Risk) کو بہتر طور پر سنبھالا جا سکتا ہو؛
(v) مزید نقصان کو روکنے کے لیے فوری توجہ کی ضرورت ہو؛
(vi) منصوبہ حساس نوعیت کا ہو اور متعلقہ معلومات کو پرائیویٹ سیکٹر کے ساتھ شیئر نہ کیا جا سکتا ہو۔

Contract Closure — کانٹریکٹ کا اختتام (بندش)

(6) GRC شکایت موصول ہونے کے دس دن کے اندر اس کی جانچ کرے گی اور اس پر فیصلہ کرے گی۔
(7) GRC کے فیصلے سے ناخوش کوئی Bidder یا فریق رپورٹ کے کسی بھی حصے پر اعتراض اٹھا سکتا ہے، بشرطیکہ Single Stage Single Envelope یا Single Stage Two Envelope Bidding کے طریقہ کار کے تحت کی گئی Technical Evaluation Report کے خلاف کوئی اعتراض قابل قبول نہ ہو۔

قواعد کی خلاف ورزی کرنے والی کسی بھی غیر مجاز کارروائی کو Procurement Misconduct کہا جائے گا۔
